Industrial Deafness Claims

Where hearing protection is provided, often, it is not adequate or suitable. Ancillary to deafness is tinnitus, which is a ringing or buzzing sound in the ears. The two conditions normally come hand in hand.

Occupational deafness can occur as a result of exposure to excessive noise in a wide range of industries and environments.

Often, people do not realise that their symptoms of deafness or tinnitus have been caused by their occupation and will simply put it down to age, a build up of wax or even an ear infection.  Establishing blame for personal injury will very much depend on the level of noise exposed to and the duration and frequency of exposure. 

It is extremely important that Claimants are aware of when their symptoms began as the onset of symptoms will determine when limitation expires, in other words; when a Claimant is out of time to bring their claim.  In cases of industrial disease, the timescales for bringing a claim are 3 years from the date of knowledge that the condition is work related. Factors to be taken into account will be when the condition was thought to be significant, when the connection was made and when a person might reasonably have known.
