What we do when dealing with your residential sale or purchase?
For the Seller:
  • take details of all relevant information relating to the transaction
  • obtain the deeds and documents
  • examine the title to the property and prepare a draft contract
  • send the draft contract to the buyers conveyancer with a copy of the title documentation, a completed Property Information Questionnaire and a list of fixtures, fittings and contents included in the sale
  • reply to any further enquiries raised by the buyers conveyancer
  • get the contract signed and agree proposals for a completion date (moving date)
  • exchange contracts with the buyer’s Solicitor at which point the agreement to buy and sell becomes legally binding and the moving date is fixed.
  • receive the deposit traditionally 10% of the sale price but often less depending upon the circumstances. The completion date is inserted in the contract and when there is a related purchase we will ensure that the two transactions proceed simultaneously
  • obtain details of the amounts required to repay any mortgages on the property
  • agree the form of the transfer deed with the buyer’s conveyancer and obtain the sellers signature to it
  • receive the balance of the purchase monies on the completion date, hand over the title documentation, repay outstanding loans and arrange for the keys to be released
  • report to the seller and deal with any other outstanding issues
For the Buyer:
  • take details of all relevant information relating to the transaction
  • consider the draft contract, title documentation and other documents received from the seller’s conveyancers
  • carry out a Local Authority search, water and drainage search, an Environmental Risk Assessment and any other searches which may be needed because of the location of the property - for example a British Coal search in coal mining areas
  • make further enquiries of the seller’s conveyancers about relevant issues - for example planning and rights of way or restrictive covenants which may affect the property
  • receive instructions from your mortgage lender (if a mortgage is required) and deal with the legal requirements relating to their security
  • report to the buyer fully about the property in writing
  • prepare the transfer deed and mortgage documents for signature by the buyer
  • see the buyer to go through the documentation, deal with the deposit and get the contract signed in readiness for exchange (or if the buyer would prefer these documents can be posted)
  • agree proposals for a completion date (moving date)
  • exchange contracts with the seller’s conveyancers and pay the deposit at which point at which point the agreement to buy and sell becomes legally binding and the moving date is fixed - when there is a related sale we will ensure that the two transactions proceed simultaneously
  • report to the lender and obtain the mortgage money
  • make final searches and obtain any further monies needed from the buyer
  • complete the purchase on the completion date by despatching the balance purchase monies to the seller’s conveyancers and receiving the transfer deed and other title documentation
  • report to the buyer and deal with any other outstanding issues
  • complete a Stamp Duty Land Tax return and pay the tax
  • register the buyer as the new owner of the property at the Land Registry
  • forward the title documents to the mortgage lender (if applicable) and send copies of all relevant documents to the buyer
