The death of a family member, relative or friend is, to say the least, a difficult time for all concerned. A sympathetic and helpful approach from the various professionals who become involved will certainly help. At Bridge McFarland we always try to handle the legal issues in this way. Members of the firm who deal with Probate and the Administration of Estates are always pleased to talk to relatives of the bereaved and others affected and to offer advice as to both what needs to be done and the best way forward.
Usually it will be necessary to obtain either a Grant of Probate (where there is a will) or a Grant of Letters of Administration (where there is not). This is a formal document issued by the Probate Registry which authorises third parties to deal with either the Executors appointed in a will or the Administrators appointed (where there is no will) in connection with a particular estate. We will help with the application for the Grant and deal with the tax issues which have to be resolved before it can be obtained. When the Grant is received we will assist with the administration of the assets and liabilities and the distribution of the estate to beneficiaries. Our role is to ensure that everything is dealt with properly and in a timely manner so that when an estate is wound up there are no issues left outstanding thus enabling everybody to move forward with confidence.
