Botched Foot Surgery

Stephen Lambert won £100,000 in compensation for a lady who was left with a shortened left foot by an inappropriate and botched operation to remove painful corns at Pilgrim Hospital, Boston, in 1983, when she was just 32. She suffered years of pain and discomfort but was led to believe by her GP and consultant that nothing more could be done.

Our Client was left with a shortened left foot by an inappropriate and botched operation to remove painful corns at Pilgrim Hospital, Boston, in 1983, when she was just 32.She suffered years of pain and discomfort but was led to believe by her GP and consultant that nothing more could be done and she resolved to accept the situation as her lot.

Stephen Lambert issued court proceedings but the claim was vigorously defended initially by the hospital, which is now run by the United Lincolnshire Hospitals NHS Trust, and subsequently by the East Midlands Strategic Health Authority which was responsible for the running of the hospital in 1983.

Claims for damages in clinical negligence cases must usually be brought within three years and it was argued that our client should not be allowed to bring her case because of the time involved, despite the years of pain she had suffered.

Bridge McFarland LLP went to trial on this single issue and, fortunately, the judge found emphatically in our client’s favour. Even at this stage, the other side continued to deny liability but eventually indicated a wish to settle shortly before the start of a full trial. The client was awarded £100,000 in compensation as a result.

What is medical negligence?
Medical Negligence is when a medical practitioner such as a doctor, nurse, midwife, dentist or an institutional health provider breaches his or its duty of care to you and you are injured as a result of that breach.
