GP Negligence - Failure to advise on the benefits of taking folic acid during pregnancy

Bridge McFarland LLP won £30,000 for a lady whose GP failed to provide her with prophylactic folic acid or advise her regarding the taking of folic acid at the time of removal of her contraceptive device. As a result, her baby developed a severe form of spina bifida and sadly had to be delivered stillborn at 33 weeks pregnant. This lead to the Claimant developing severe psycological injuries.

The Claimant pursued a claim against her GP for failing to provide her with prophylactic folic acid or advise her regarding the taking of folic acid at the time of removal of a contraceptive device.  As a result of not taking the folic acid the Claimant’s baby developed anencephaly, which is a severe form of spina bifida caused by a neural tube defect.  This was diagnosed when the Claimant was 21 weeks pregnant.  She was advised that the baby would not survive and the baby was delivered stillborn when the Claimant was 33 weeks pregnant.  The claimant developed severe psychological injuries as a result.  The Defendant did not make any admissions of liability and court proceedings were issued.  The case proceeded almost to trial before the Defendant made proposals for settlement.  The case finally settled, before trial, for £30,000.​
