Bridge McFarland LLP was instructed in connection with a catastrophically injured claimant further to a serious accident at work.

Our client, who prior to the accident had been employed at a Shipping Port for a number of years, was one of a group of employees who were engaged in unmooring a  vessel from the docks. The rope had not been secured correctly earlier in the day by another employee, which led to the rope coming loose and striking our client at close range.

As a consequence of the accident our client sustained significant fractures and dislocation injuries which required surgery.

The claim was pursued against two defendants, the clients employer and the local port operator.

It was necessary to obtain medical evidence from a Consultant Orthopaedic Surgeon and Consultant Clinical Psychologist in order for the Claimant’s injuries to be quantified. A Marine Expert also attended the jetty where the accident happened to consider breach of duty in further detail.

Both Defendants blamed each other for a significant period of time, when the impending court proceedings drew nearer the Defendants compromised in a joint settlement meeting where all parties were in attendance. The liability was split between the Defendants.

Our clients claim ultimately settled for nearly £400,000 and settlement was achieved on the basis that it was unlikely that they would be in a position to revert to their former employment due to the extent of the injuries sustained in the accident.
