Our client was experiencing frequent stomach pains and arranged an appointment to see her GP, who then referred her to a General Surgeon who diagnosed her with Costochondritis.

After the prognosis stomach pains were still being experienced hence another appointment was arranged to see her GP and from here a further diagnosed of Fibromyalgia was given.

A couple of years later and stomach pain was causing further problems to our client, still experiencing pain and discomfort. Alongside this she was losing weight but felt as though her stomach was bloating and increasing in size. Shortly after Cancer was diagnosed, and sadly our client passed away leaving a family behind.

It was argued and eventually admitted that earlier ultrasound scans performed could and should have alerted medical professionals to an abnormal ovary, which should have been investigated further, leading to earlier recognition of the disease.

An avoidable delay in diagnosis led to a tragic outcome for this family, no amount of compensation can change the sad circumstance but financial support from a compensation settlement allows for some financial security at an incredibly difficult time.

Can I make a medical negligence claim on behalf of someone who has died?
Yes. Only, if you are the spouse of the Deceased or Executor of the Estate.
How can I find out if medical treatment was negligent?
During the investigations of your clinical negligence claim we will be required to obtain disclosure of all relevant medical records - both hospital and GP - in the manner set out in the pre-action protocols. Once all of the relevant medical records have been received they will be considered on a preliminary basis. They will then be sent to an independent expert nurse who will index and paginate the records to ensure that they are in some semblance of order.
