Legal Proceedings

Court proceedings

We will issue and serve a claim for payment of the debt and any interest, fixed sum and recoverable legal costs. The debtor can then admit the claim and agree to pay or indicate its intention to defend within 14 days. If they fail to do either, we will apply for a judgment in default, which can then be enforced as a County Court judgment (CCJ).

We offer a range of flexible funding options, including fixed and contingent fees, for issuing court proceedings. Court fees are also payable on issuing a claim.

If a claim is defended, it can be handed over to our team of expert Dispute Resolution lawyers.

Insolvency proceedings

For certain undisputed debts, insolvency proceedings can be a useful alternative to court proceedings. The presentation of a winding-up or bankruptcy petition will have a serious impact on a debtor's ability to continue trading and a debtor wishing to avoid these repercussions, and the risk of a winding-up or bankruptcy order, will have to pay or provide security for the debt, interest and legal costs. This can be a very effective tool for recovering payment of undisputed debts.
