Legal Proceedings

Court proceedings

We will issue and serve a claim for payment of the debt and any interest and recoverable legal costs. The debtor may admit the claim and agree to pay or indicate its intention to defend. If the debtor fails to do either, we will apply for a judgment in default, which can then be enforced as a County Court judgment (CCJ).

We offer a range of flexible funding options, including fixed and conditional fees, for issuing court proceedings. Court fees are also payable on issuing a claim.

If a claim is defended, it will be handed over to our team of specialist Dispute Resolution lawyers.

Insolvency proceedings

For some undisputed debts, insolvency proceedings are a useful alternative to court proceedings. The presentation of a winding-up or bankruptcy petition will have a serious impact on a debtor and in order to avoid a  winding-up or bankruptcy order, a debtor must pay or provide security for the debt, interest and legal costs.
